Cancellations and Refunds

• Orders may be cancelled up to 24 hours before scheduled delivery for full refund
• Cancellations within 24 hours may incur fees based on order stage
• Custom arrangements and perishable items may not be eligible for refund
• Class registrations may be cancelled up to 48 hours in advance for refund

4. Delivery Terms

• Delivery times are estimates and not guarantees
• Recipients must be available to accept delivery during specified timeframe
• If recipient is unavailable, arrangements may be left in safe location at our discretion
• We are not liable for arrangements left per delivery instructions after photo confirmation
• Delivery address must be accurate and complete; address errors may incur additional fees

5. Product Information and Substitutions

• Images are representative; actual arrangements may vary based on seasonal availability
• We reserve the right to substitute flowers or materials of equal or greater value
• Color variations and natural characteristics are inherent to fresh flowers
• Container styles may vary while maintaining overall aesthetic and value

6. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of bloom bca or its content suppliers and is protected by Canadian and international copyright laws.

• Users may not reproduce, distribute, modify, or create derivative works without written permission
• Arrangement designs are proprietary and protected intellectual property
• Limited license granted for personal, non-commercial use only

7. Limitation of Liability

Services are provided "as is" without warranties of any kind, either express or implied. To the fullest extent permitted by law:

• We do not guarantee specific results or outcomes from our services
• Arrangement longevity depends on care, environmental factors, and flower variety
• Our liability is limited to the amount paid for the specific service or product
• We are not liable for indirect, consequential, or special damages
• Force majeure events (weather, natural disasters, supplier issues) may affect service delivery

8. Dispute Resolution

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law provisions.

Resolution Process

1. Informal Resolution: Contact us directly to resolve disputes amicably
2. Mediation: If informal resolution fails, parties agree to attempt mediation
3. Arbitration: Unresolved disputes may proceed to binding arbitration in Hamilton, Ontario
4. Jurisdiction: Courts of Ontario have exclusive jurisdiction for any legal proceedings

9. Termination

• We may terminate or suspend access immediately for violations of these Terms
• Users may discontinue use of services at any time
• Certain provisions survive termination, including payment obligations and liability limitations
